Terms of Service

1. Acceptance of Terms

By creating an account or using DevLevelUp ("the Service"), you agree to these Terms of Service and our Privacy Policy. If you are accepting on behalf of a company or other legal entity, you represent that you have authority to bind that entity.

We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms.

2. Description of Service

DevLevelUp provides a B2B SaaS platform for competency management, skill assessment, and employee performance reviews. The Service includes:

• Skill matrix management with role-based competency expectations
• 360-degree performance review cycles (manager, self, peer assessments)
• Individual development plans and progress tracking
• Team analytics and reporting dashboards
• Bulk employee onboarding tools

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

You must be at least 18 years of age and have the legal capacity to enter into contracts. Accounts are not transferable.

We reserve the right to suspend or terminate accounts that violate these terms or are used for fraudulent purposes.

4. Subscription Plans and Payments

DevLevelUp offers the following subscription tiers:

• Free Plan: Up to 5 users, 1 active review cycle. No payment required.
• Pro Plan: Up to 50 users, unlimited review cycles, full analytics, and peer review features. Billed monthly.
• Enterprise Plan: Unlimited users, custom roles, API access, and dedicated support. Contact us for pricing.

All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

Refund Policy: Subscriptions are non-refundable except where required by applicable law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable regulations
• Upload or transmit harmful, defamatory, or abusive content
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Use automated tools to scrape, crawl, or extract data from the Service
• Resell or sublicense access to the Service without written permission
• Interfere with or disrupt the Service's integrity or performance

6. Data and Privacy

By using the Service, you acknowledge that you have read and understood our Privacy Policy. You retain ownership of all data you input into the platform.

You grant DevLevelUp a limited license to store, process, and display your data solely for the purpose of providing the Service. We will not sell your data to third parties.

You are responsible for ensuring that your use of the Service complies with applicable data protection laws, including obtaining necessary consents from your employees.

7. Intellectual Property

The DevLevelUp platform, including its software, design, skill taxonomy, and competency frameworks, is owned by DevLevelUp and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary content.

The skill catalog (roles, skills, levels, expectations) is the exclusive intellectual property of DevLevelUp. You may use it within the Service but not export or reproduce it for commercial purposes outside the platform.

8. Service Availability and SLA

We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects availability and will provide advance notice when possible.

The Service is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose.

9. Limitation of Liability

To the maximum extent permitted by law, DevLevelUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability to you for any claim arising from these terms or your use of the Service shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Termination

Either party may terminate the agreement at any time. Upon termination:

• Your access to the Service will cease immediately
• You may request an export of your data within 30 days of termination
• After 30 days, we may delete your data in accordance with our retention policy

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable international law. Any disputes shall first be attempted to be resolved through good-faith negotiation.
